Introduction

The Marketplace Privacy Policy terms are entered into by and between you, whether as a Consignor, Seller, Buyer, or User (“You,” “you,” “User,” or “user“) and MBSD Family Corp (“MBSD,” “mbsdpipes.com,” “We,” “we,” “Our,” “our,” “Us,” or “us“).

Privacy Policy

We respect your privacy and are committed to complying with this policy.

This policy describes the types of information MBSD may collect from you or that you may provide when you visit, use, or register with the website MBSDpipes.com (the “Marketplace“) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to the information MBSD collects:

On or through the Marketplace.
Email, text, and other electronic messages between you and the Marketplace.
Through any mobile and desktop applications you download from the Marketplace, which provides dedicated non-browser-based interaction between you and the Marketplace.
When you interact with MBSD’s’ advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

MBSD offline or through any other means, including on any other website operated by MBSD or any third party (including MBSD’s affiliates and subsidiaries) or
Any third party (including MBSD’s affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Marketplace.
Please read this privacy policy carefully to understand MBSD’s policies and practices regarding your information and how MBSD will treat it. If you disagree with MBSD’s policies and practices, your choice is not to use the Marketplace. By accessing or using the Marketplace, you agree to this Privacy Policy. Certain features or services referenced in this Privacy Policy may not always be offered on the Marketplace. This privacy policy may change occasionally (see “Changes to Our Privacy Policy“). Your continued use of the Marketplace after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates. Please also review MBSD’s Marketplace Terms Of Use, which govern your use of the Marketplace and the services offered thereon.

Children Under the Age of 13

The Marketplace is not intended for children under 13 years of age. No one under age 13 may provide Personal Information to or on the Marketplace. MBSD does not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on or through the Marketplace or on or through any of its features, including but not limited to registering an account on the Marketplace, submitting any bids, or making any purchases on or through the Marketplace, using any of the interactive or public comment features of the Marketplace or providing any information about yourself to MBSD, including your name, address, telephone number, email address, or any screen name, user name or other moniker you may use. If MBSD learns it has collected or received personal information from a child under 13 without verification of parental consent, MBSD will delete that information. If you believe MBSD might have any information from or about a child under 13, please get in touch with MBSD as prescribed in the Contact Information section.

Information MBSD Collects About You and How MBSD Collects It

MBSD collects several types of information from and about users of the Marketplace, including information:

By which you may be personally identified, such as name, postal address, email address, telephone number, payment details, or any other identifier by which you may be contacted online or offline (“Personal Information“);
That is about you but individually does not identify you, such as the contents of your User Contributions, demographic data, and zip codes.
About your internet connection, equipment to access the Marketplace, and usage details.

MBSD collects this information:

Directly from you when you provide it to MBSD.
Automatically, as you navigate through the Marketplace, information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
From third parties, such as MBSD’s business partners.

Information You Provide to MBSD. The information MBSD collects on or through the Marketplace may include:

Information that you provide by filling in forms on the Marketplace. This includes information provided when registering to use the Marketplace, subscribing to any of MBSD’s services, Posted User Contributions or other information/material, buying or providing items, content, or services on or through the Marketplace, or requesting further services. MBSD may also ask you for information when you enter a contest or promotion sponsored by MBSD and when you report a problem with the Marketplace.
Records and copies of your correspondence (including email addresses) if you contact MBSD.
Your responses to surveys that MBSD might ask you to complete for research purposes.
Details of transactions you carry out on or through the Marketplace and the fulfillment of your orders. You may be required to provide financial information before placing an order through the Marketplace.
Your search queries on the Marketplace.

You also may provide information to be published or displayed (“Posted“) in public areas of the Marketplace or transmitted to other users of the Marketplace or third parties (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at risk. Although MBSD limits access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, MBSD cannot control the actions of other users of the Marketplace with whom you may choose to share your User Contributions. Therefore, MBSD does not guarantee unauthorized persons will not view your User Contributions.

Information MBSD Collects Through Automatic Data Collection Technologies. As you navigate through and interact with the Marketplace, MBSD may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

Details of your visits to the Marketplace, including traffic, location, logs, and other communication data and the resources you access and use on or through the Marketplace.
Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information MBSD collects automatically may include Personal Information, or MBSD may maintain it or associate it with Personal Information MBSD collects in other ways or receives from third parties. It helps MBSD to improve the Marketplace and to deliver better and more personalized service, including by enabling MBSD to:

Estimate audience size and usage patterns.
Store information about your preferences, allowing MBSD to customize the Marketplace according to your interests.
Speed up your searches.
Recognize you when you return to the Marketplace.

The technologies MBSD uses for this automatic data collection may include:

Cookies (or browser cookies). A cookie is a small file placed on your computer’s hard drive. You may refuse to accept browser cookies by activating the appropriate settings on your browser. However, if you select this setting, you may be unable to access certain parts of the Marketplace. Unless you have adjusted your browser setting to refuse cookies, MBSD’s system will issue cookies when you direct your browser to the Marketplace. Flash Cookies. Certain features of the Marketplace may use locally stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on the Marketplace. Flash cookies are not managed using the same browser settings used for browser cookies. Web Beacons. Pages of the Marketplace and MBSD emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit MBSD, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

MBSD does not automatically collect personal information, but it may link this information to personal information about you that it collects from other sources or that you provide to MBSD.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Marketplace are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or with web beacons or other tracking technologies to collect information about you when you use the Marketplace. The information they collect may be associated with your Personal Information, or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

MBSD does not control these third parties’ tracking technologies or how they may be used. You should contact the responsible provider directly if you have any questions about an advertisement or other targeted content. How MBSD Uses Your Information

MBSD uses information that it collects about you or that you provide to MBSD, including any Personal Information:

To present the Marketplace and its contents, offerings, and services to you.
To provide you with information, products, content, and services you request from MBSD.
To facilitate and process transactions that take place on or through the Marketplace.
To fulfill any other purpose for which you provide it.
To provide you with notices about your account.
To carry out MBSD’s obligations and enforce MBSD’s rights arising from any contracts between you and MBSD, including billing and collection.
To notify you about changes to the Marketplace or any products or services MBSD offers or provides through it, Marketplace disruptions, or security updates.
To conduct a technical analysis to determine how to improve the Marketplace, including the offerings and services provided on or through it.
To allow you to participate in interactive features on the Marketplace.
To provide general administrative and performance functions and activities.
In any other way, MBSD may describe when you provide the information.
For any other purpose with your consent.

MBSD may also use your information to contact you about MBSD’s own and third-party products, offerings, and services that may interest you. If you do not want MBSD to use your information this way, please get in touch with us as prescribed in the Contact Information section. MBSD may use the information it has collected from you to enable MBSD to display advertisements to MBSD advertisers’ target audiences. Even though MBSD does not disclose your Personal Information for these purposes if you opt-out, click on, or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

MBSD may disclose aggregated information about MBSD users and information that does not identify individuals without restriction.

MBSD may disclose Personal Information that MBSD collects or you provide as described in this privacy policy:

To MBSD’s subsidiaries and affiliates.
To contractors, service providers, and other third parties, MBSD supports our business. Who are bound by contractual obligations to keep personal information confidential and use it only for the purposes MBSD discloses.
To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of MBSD’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by MBSD about Marketplace users is among the assets transferred.

To fulfill the purpose for which you provide it.
For any other purpose disclosed by MBSD when you provide the information.
With your consent.

MBSD may also disclose your Personal Information:

To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
To enforce or apply the Marketplace Terms of Use and other agreements, including for billing and collection purposes.
If MBSD believes disclosure is necessary or appropriate to protect the rights, property, or safety of MBSD, our customers, or others. This includes exchanging information for fraud protection and credit risk reduction with other companies and organizations.

Choices About How MBSD Uses and Discloses Your Information

MBSD strives to provide you with choices regarding the Personal Information you provide to MBSD. MBSD has created mechanisms to provide you with the following control over your information:

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. To learn how to manage your Flash cookie settings, visit Adobe’s Flash player settings page. If you disable or refuse cookies, please note that some parts of the Marketplace may be inaccessible or malfunctioning.

Disclosure of Your Information for Third-Party Advertising. Suppose you do not want MBSD to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes. In that case, you can opt out by emailing MBSD your request to ma*********@MB*******.com .

Promotional Offers from MBSD. If you do not wish to have your email address or other contact information used by MBSD to promote our own or third-party products or services, you can opt-out via email, stating your request to ma*********@MB*******.com . If MBSD has sent you a promotional email, you may send MBSD a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to MBSD due to a product purchase, product service experience, or other transactions.

Targeted Advertising. If you do not want MBSD to use information that MBSD collects or that you provide to MBSD to deliver advertisements according to MBSD advertisers’ target-audience preferences, you can opt-out by emailing ma*********@MB*******.com .

MBSD does not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. For example, you can opt out of receiving targeted ads from the Network Advertising Initiative (“NAI”) members on the NAI’s website.

Accessing and Correcting Your Information

You are responsible for maintaining the accuracy of the information you submit to MBSD, such as your contact information, and you must promptly update any changes through your Marketplace account. You can review and change your Personal Information by logging into the Marketplace and visiting your account profile page.

You may also email MBSD at ma*********@MB*******.com to request access to, correct, or delete any Personal Information you have provided to MBSD. MBSD cannot delete your Personal Information except by deleting your user account. MBSD may not accommodate a request to change information if MBSD believes the change would violate any law or legal requirement or cause the information to be incorrect.

Suppose you delete your User Contributions from the Marketplace. In that case, copies of your User Contributions may remain viewable in cached and archived pages or have been copied or stored by other Marketplace users. The Marketplace Terms govern the proper access and use of information provided on the Marketplace, including User Contributions, governed by the Marketplace Terms of Use.

If your account is deactivated or you ask to close it, you will no longer access the Marketplace or any services provided thereon. MBSD will use commercially reasonable efforts to honor your request; however, certain information will actively persist on or in the Marketplace even if you close your account, including information in any User Contributions you Posted to the Marketplace. In addition, your Personal Information may remain in MBSD’s archives, and information you update or delete, or information within a closed account, may persist internally or for MBSD’s administrative purposes. It is not always possible to remove or delete information from MBSD databases altogether. In addition, MBSD typically will not remove information you posted through or on the Marketplace. Please remember that neither you nor MBSD can delete all copies of information previously shared with others on the Marketplace.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Marketplace who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, contact MBSD as prescribed in the Contact Information section.

You must put the statement “Your California Privacy Rights” in the subject field of your email and include your name, street address, city, state, and ZIP code. MBSD will respond to you at your mailing or email address, which is MBSD’s option. MBSD is not responsible for notices that are not labeled or sent properly or do not have complete information.

Data Security

Your privacy and the security of your information are vital to MBSD. The safety and security of your information also depend on you. Where MBSD has given you (or where you have chosen) a password for access to certain parts of the Marketplace, you are responsible for keeping this password confidential. MBSD asks you not to share your password with anyone. MBSD urges you to be careful about giving out information in public areas of the Marketplace, such as message boards. The information posted, or that you otherwise share, in public areas may be viewed by any user of the Marketplace.

From time to time, MBSD reviews MBSD security procedures (including those of MBSD’s partners) to consider appropriate modern technology and methods. However, Please be aware that, despite MBSD’s best efforts, no security measures are perfect or impenetrable.

Unfortunately, information transmission via the Internet is not completely secure. Although MBSD attempts to protect your Personal Information, MBSD cannot guarantee the security of your Personal Information transmitted to the Marketplace. Any transmission of Personal Information is at your own risk. MBSD is not responsible for circumventing any privacy settings or security measures contained on the Marketplace or provided by MBSD (or MBSD’s partners).

Phishing

Phishing websites imitate legitimate websites to obtain personal or financial information. Identity theft and the practice known as “phishing” concern MBSD greatly. For more information about phishing, visit the Federal Trade Commission at https://www.consumer.ftc.gov/articles/0003-phishing. In addition, if you believe you have received an email or had a similar interaction with a third party pretending to be MBSD, please report it to us as prescribed in the Contact Information section.

International Transfer of Personal Information

MBSD is a United States company. If you are located outside the United States and still choose to provide information to MBSD or on the Marketplace, be aware that MBSD transfers Personal Information to the United States for processing. The U.S. may not have the same data protection laws as the country where you initially provided the information. When MBSD transfers your information to the U.S., MBSD will protect it only as described in this Privacy Policy. By visiting the Marketplace or providing MBSD with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your data in the United States.

Changes to Our Privacy Policy

It is MBSD’s policy to post any changes MBSD makes to this Privacy Policy on this page. Suppose MBSD makes material changes to how MBSD treats Marketplace users’ Personal Information. In that case, MBSD will notify you by email to the email address specified in your account or through a notice on the Marketplace home page. The date the Privacy Policy was last revised is at the top of the page. You are responsible for ensuring MBSD has an up-to-date, active, and deliverable email address for you and for visiting the Marketplace and this Privacy Policy every time you log in to check for any changes.
